Provisions should be adopted to require claims for judicial review to be served on
respondents and on other persons known to be interested in the proceedings.
Provisions should be adopted to require respondents who wish to contest the proceedings to
acknowledge service and to summarise the grounds relied on.
As indicated above, the present arrangement is for an applicant to seek leave to move
for judicial review on an entirely ex parte basis. Neither the proposed respondent nor
any interested party is served with the application or the supporting evidence. They
are not brought into the picture unless and until the applicant succeeds in obtaining
leave.
