Proposal 7
Part 11 of the CPR should be adopted to govern applications to challenge the court's
jurisdiction or to invite it to decline jurisdiction.
Order 12 r 8 should be amended to the extent necessary to bring into its scheme for disputing
the court's jurisdiction, applications for the court to decline to exercise jurisdiction over the
plaintiff's claim and to grant a discretionary stay of the action.
