Consultation response to Proposal 37
This proposal addressed the second strategy mentioned above, namely, that of
introducing greater flexibility by allowing witness statements to be supplemented
orally with a view to discouraging the over-working of witness statements. It attracted
general support.
A number of respondents added the rider that such flexibility should not be secured at
the cost of allowing the other party to be taken by surprise.
