Although Order 22 may have to be re-written so that new provisions and terminology
introducing reforms regarding the plaintiff's position can be accommodated, the
Working Party's view is that the defendant's position under Order 22 should in
substance be preserved, but with the addition of the innovations and ancillary
provisions referred to above.
Recommendation 39: The defendant's position under Order 22 should in
substance be preserved, but with the addition of the relevant ancillary provisions
found in CPR 36.
