The Working Party considered the proposal that the present tests applicable to the
summary disposal of proceedings should be replaced by a "no reasonable prospect of
success" test. In the light of consultees' responses and since the benefits of adopting
such a test are thought to be questionable, Proposal 14 was not supported.
