The consultation response
Proposal 7 attracted little comment. Some who responded
suggested that this was
not a necessary change. One respondent expressed the concern that adoption of the
CPR rule would require the plaintiff to incur the costs of delivering a statement of
claim before knowing whether the defendant was intending to mount a challenge to
jurisdiction.
